This FILERACK Service Agreement (the "Agreement") describes the terms and conditions on which FILERACK Ltd. (hereinafter "Company", "we", "our" or "us") offers file hosting services to you (hereinafter “Customer", “Client”, "user", "you" or "your"). By using our file hosting website, users accepts and agrees to all the provisions of this service contract that may be modified or updated from time to time at the discretion of FILERACK. Customers are completely bound by the below outlined service agreement and subject to all the following terms of service (TOS):

• As your file hosting service provider, we reserve all the rights to disable direct linking for user accounts that are using excessive bandwidth or otherwise, anyway abusing or harming our file hosting system.

• Pornography, nudity, sexual images and any kind of offensive data, files or images are entirely prohibited. Copyrighted material is also strictly prohibited. The Company wholly reserves all the rights to decide appropriate content and can immediately take action to delete your images or files at any time without any user notification.

• Users must fully agree to comply with all the rules and laws which apply to their geographical location, country; including copyright and trademark laws. Client data, files and images that violate copyrights or trademarks are strictly and totally not allowed.

• If someone has an infringement claim against you, we will inform you to instantly remove the copyrighted file until the issue is resolved. If there is a dispute between any participants, customers or users on our file hosting site, we at FILERACK are under no obligation to become involved.

• FILERACK is not responsible or liable for any of your images, data or files or any lost business due to the unavailability or loss of our file hosting website. We, as a file host make no claims of future reliability in serving, hosting or storing your images, data or files.

• FILERACK is committed to fully co-operate with any and all legal authorities, if an investigation should arise.
